Can You Win Your Social Security Disability Case Without a Hearing?
Can you win your Social Security disability case WITHOUT the need for a hearing before a Social Security judge?
You may have heard that Social Security denies most disability applications. This is not exactly true - in fact, about 33% of all applications are approved by Social Security adjudicators, often within 6 to 10 months after filing.
What are the characteristics of a claim that will be approved early?
As I discuss in this video, most of the cases approved early are "listing level" cases. These are cases where the disability applicant has a life-limiting or life-threatening illness.
If you don't have a life-limiting illness you can still win early but it is much more difficult. You would need an EXTENSIVE medical record documenting a significant medical condition along with evidence that your condition PREVENTS you from working.
THE OVER 55 ADVANTAGE
We have also found that our clients over the age of 55 have a much better chance at an early approval. For claimants over age 55 we can often make a "grid rule" argument to ask for an early favorable decision.
If you do not win early you should not give up. While you may end up waiting 18 to 30 months for a hearing, a disability judge has a lot more authority to evaluate evidence.
Right now almost 50% of cases that go to hearings are approved. These are cases that were denied twice but were eventually granted by a judge.

    How is ssdi calculated, Is it high 1 high5. Or top 35 years and is it calculated to Whats best for the client

      Each person's calculations are different. The years worked makes a difference, average indexed monthly earnings plays a part and there are percentages that get figured into this equation. No 2 person's are the same. You should probably request a calculations breakdown of your particular situation.

      If your medical records are substantial and clear-cut, it's not mandatory or required that everyone gets sent for a CE.

    My experience was, bs, Applied, denied appealed denied, judge , denied . Review Denied. Re Applied Approved!!! Because I didn't go through the process of suing. I lost 5 years of back pay. Judge excuse was if I'd loose the 30 extra lbs I would not be in pain. 5 freaking years. No wonder people end up homeless on the streets , doing street drugs. I'll bet if someone took a poll , I'll bet half the people are in pain & where denied disability. It didn't help that the 1st disability lawyers, stopped doing disability cases. So they sent me thru an attorney who pealed off that company and stated his own company, looking like I switched lawyers. & then a year in he Decided he was moving back to his small town to be a lawyer. There & again refered me to someone else. So again looked like I switched lawyers. Truth was I had no choice. & all three firms agreed, that my case should be approved in no time , since they had seen others not as bad off as me win there cases. So I knew I had a case. If they had said no I never would have persuade it. Would have kept trying to work through the pain . Even though my job let me go when I could no longer meet the physical requirements. Or pass a piss test. I thought that was illegal & another story. But it was the 3rd lawfirm when I finally saw a judge. I think he held the 3 lawfirms against me as well. But it literally wasn't by choice & I tried explaining that.

    I am told I'm over income so I'm not getting what they say I'm getting.I receive disability and Medicare and I'm receiving 1,040 monthly with 120 up to 174 a month food for food.its never just stayed the same.I just don't know who or where to seek advice and need help to fill paperwork.Can you point me in the right direction..🥰 thanks for all your info God bless

    Yes, I smoke. something I have done for 52 years. I am still trying to quit,k tried freaking everything, no joy. But smoking, possibly, is not my issue. Covid in april 2020 when we knew nothing pretty much killed me. Everything was affected, but my kidneys. I mean everything. I don't expect to live long, and I have been given 10-12 years after being diagnosed with the various aftermath of covid 4 years ago. Ya know what? I don't care. I don't! I did what I could for people, raised my kids well, and so what have I to complain about? Nothing. I'm ready. Come get me.

    I haven't worked in 2.5 years. I finally gave that up after getting covid in april 2020. Horrible daily headaches, can't keep a thought in my head long enough to act upon it, heart rate 250 just getting a cup of coffee in my kitchen. I had a heart attack, then stroke. Lost eye sight in my right eye. Now I get shots every 6 weeks. expensive and they really hurt. My heart has mild damage and my digestive system is screwed up as well as my liver and my blood pressure. It could be 90/60 or 185/125. I passed out because of it, sent my desk across the room when my head hit it when going down. Woke up 3 hours later feeling like I'd been struck by lightning. Urgent surgery needed, they said, or be a quad. Only they won't do it due to the erratic BP. I called uncle at work. I was the person who solved problems no one else could, and now I am an idiot. I can't even remember the problem, let alone solve it! My boss was willing to wait until I got back to normal. There isn't any normal here, not after covid. I wish. I miss me!

    How do you get your attorney to actually stop and ask those questions and address them. I feel like no one has stopped to actually understand my disability. They look at the diagnosis but they don't understand the condition so they dismiss what is really going on.

      If you are having trouble with a conversation it can be helpful to put your thoughts into writing. Remember that the main issue in an SSD case has to do with why you no longer have the capacity to work. Understand that SSD hearings last 45 minutes so SSD attorneys will want to focus on the core issues.

    QUESTION: If you have a verified critical heart condition that has persisted for more than 2 years and has been deemed to result in your death, you're older than 55, but you have retirement income that exceeds $80/yr, is it likely you'll be denied because of your income?

      I assume you mean $80k per year. If your income is passive (i.e., not from employment) you should not have an issue. But if you are working despite your cardiac issues then by SSA's definition of disability you are not disabled.

    Question I get SSDI and work part time and I m paid just under SGA, but I participate in the 401k. Does the company Match count as income?

      That is a very interesting question. I don't know but will try to find out. My gut is that if the 401k match is part of your gross income for tax reporting purposes then the total on the W2 would be what SSA will use.

      I answer a lot of different questions, most of which are from people who give me a fact pattern and ask if I think they have a case. Bottom line: the strongest cases are ones where you have a diagnosed medical condition that results in very specific work activity limitations. It also helps greatly if you are over age 50, and even more so if over age 55.

      Paystubs and your W2 when you get it. If you file now you are unlikely to get a decision before the end of the year.

      That's not how SSA sees it. I have no problem with requring applicants to prove they are disabled. The question is how strict the definition is and how consistent are the decisions.

      First, go to ssa.gov/myaccount to see if you have enough credits. If not, you can pursue SSI but be aware of the offsets. Otherwise your options are not good.

    What if your younger than 55 but is consistent with symptoms of my condition and shows the progression of the condition. Of course my first judge assumed i wasn't a candidate for surgery because my condition wasn't that bad. I fact it shows exactly how much my condition has progressed. Wasn't caused by an incident, only 50/50% chance of working. If it did help it would likely just move up or down the spine. And lastly i would really only be able to have so many surgeries in a lifetime. Yes this was all in my records that they received. Basically i need to wait as long as possible to get surgery. But because my condition is degenerate i may never be a candidate for surgery.😢

    I hand deliver. I've always had a barcode and there are many records they never received by mail or drop-off. Nit sure if it makes a difference but at feel like ive done my due diligence.
